1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer”, “Contractor”, or “Tenant”) and BullParkIt (“BullParkIt”, “we”, “our”, or “us”). By accessing or using the BullParkIt software-as-a-service platform, including the embeddable calculator widgets, contractor dashboard, APIs, and associated web properties at bullparkit.com (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree to all terms and conditions, you must discontinue using the Service immediately.

2. Description of the Service

BullParkIt provides B2B software tools designed specifically for concrete coating, epoxy flooring, and trade contractors. The Service includes an interactive, embeddable project estimate calculator for contractor websites, an administrative dashboard for configuring pricing rates, services, and branding, automated homeowner lead capture, and lead forwarding integrations (such as email delivery, webhooks, and CRM connectivity).

3. Strict Multi-Tenant Isolation & Zero Cross-Account Sharing

Confidentiality Commitment: BullParkIt operates on a multi-tenant cloud architecture with strict cryptographic and database-level partition controls (Row-Level Security). Your business settings, pricing formulas, square-foot labor and material rates, margin structures, customer inquiries, and captured homeowner leads belong exclusively to you. BullParkIt will NEVER share, disclose, pool, sell, or cross-reference your lead data or pricing models with any other contractor, account, competitor, or third party.

4. Free Trial, Subscriptions, and Billing

4.1 14-Day Free Trial: New contractor accounts receive an initial 14-day free trial. During the free trial period, full access to features is provided without requiring an upfront credit card.

4.2 Subscription Plans: Following or during the trial, you may choose to subscribe to one of our recurring tiers:

• Basic Plan: $49.00 CAD (or USD equivalent) billed monthly. Includes branded calculator embed, unlimited client estimates, email lead delivery, and 3-day photo storage.
• Pro Plan: $129.00 CAD (or USD equivalent) billed monthly. Includes everything in Basic, full white-label customization, CRM integrations (webhooks/Workiz), 7-day photo storage, and priority support.

4.3 Payment Processing: All recurring payments, upgrades, and billing details are processed securely via Stripe, Inc. By providing payment information, you authorize BullParkIt (via Stripe) to charge the selected plan fee on a recurring monthly schedule until canceled.

4.4 Cancellation & Refund Policy: You may cancel your subscription at any time directly through the Billing tab in your dashboard or via the Stripe Customer Portal. Upon cancellation, your account will remain active through the end of the current paid billing period, after which future billing will cease and your embeddable calculator will be deactivated. We do not offer retroactive refunds for partial billing cycles once fees have been billed.

5. Nature of Calculations & Contractor Disclaimers

5.1 Preliminary Ballpark Estimates: The calculations generated by the BullParkIt calculator are preliminary ballpark estimates created using formulas, square foot rates, and markup brackets configured by you, the contractor.

5.2 Independent Contractor Autonomy: BullParkIt is a software platform, not a licensed contractor, estimator, or party to any contract between you and your homeowner clients. BullParkIt makes no representations or warranties regarding the accuracy of your chosen rates, concrete surface conditions, moisture barriers, substrate preparation needs, or the final contractual price you choose to offer your clients. You retain full responsibility for verifying all project specifications, inspecting on-site concrete conditions, and executing independent contracts with your customers.

6. Intellectual Property & Data Ownership

6.1 BullParkIt IP: The BullParkIt brand, user interface, software algorithms, calculator code, embed scripts, stylesheets, and documentation are the exclusive intellectual property of BullParkIt and its licensors.

6.2 Contractor Data Ownership: You retain sole ownership of all trademarks, logos, business names, pricing rules, customer records, and lead data you upload or generate through the Service. You grant BullParkIt a limited, non-exclusive license solely to host, process, and transmit this data for the purpose of operating the Service for your account.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BullParkIt and its officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of business goodwill, or service interruption arising out of or in connection with the use or inability to use the Service. In no event shall BullParkIt’s aggregate liability exceed the total amounts paid by you to BullParkIt during the three (3) months immediately preceding the event giving rise to the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
